These Terms and Conditions (“Terms”) govern your access to and use of our website, platform and related services (collectively, the “Platform”). By using our Platform, you agree to be bound by these Terms. If you do not agree, you must stop using the Platform immediately.

1. Marketplace Role

• Ecomobilityaids.com is a neutral online platform that connects buyers, sellers and service providers (“Users”).

• We do not own, sell, resell, provide, control or endorse any products, services or listings on the Platform.

• We do not guarantee the quality, safety, legality or accuracy of any content, product, or service offered by Users, we encourage you to take up the services of our authorised service providers to have your product serviced before using it.

2. User Responsibilities

• Users are solely responsible for the content they post, the products or services they offer and any transactions they enter into.

• You agree that any contracts, sales or service agreements are exclusively between the buyer and the seller/service provider.

• You must ensure that your use of the Platform and your transactions comply with all applicable laws and regulations.

3. No Liability

• We are not liable for any disputes, losses, damages, fraud, misrepresentation, injury or other issues that arise from:

  • Transactions between Users

  • The accuracy or legality of listings

  • The delivery, quality, or performance of goods or services

• We do not provide any warranties (express or implied) regarding the Platform, products, or services offered.

• Any reliance on User content, products, or services is at your own risk.

4. Payments and Fees

• We do not charge you to use the Platform. We do not take a commission on sales or purchases. We do add a commission to services. Payments may be processed through third-party providers. We are not responsible for errors, delays or issues caused by these providers.

• If we charge listing fees, commissions or service fees, these will be clearly disclosed before you incur them.

5. Disputes Between Users

• Any disputes must be resolved directly between the parties involved.

• While we may offer dispute resolution tools, we are not obligated to intervene and have no responsibility for resolving conflicts.

6. Prohibited Activities

Users may not:

• Post unlawful, fraudulent, misleading, discriminatory, offensive or harmful content.

• Violate intellectual property rights.

• Attempt to interfere with or harm the Platform.

• Use the Platform for scams, spam or prohibited goods/services.

We reserve the right to remove content or suspend accounts at our discretion.

7. Indemnification

You agree to indemnify and hold harmless Eco Mobility Aids, its owners, employees and affiliates from any claims, damages, losses or expenses arising out of your use of the Platform, your content or your transactions with other Users. For the avoidance of doubt, Eco Mobility Aids, its owners, employees and affiliates shall not be liable for any claims – be they civil or criminal - arising out of the use of the Platform, nor from the use or otherwise of any items purchased on the Platform. Should any items purchased on the Platform be unfit for purpose or be at fault in any way, responsibility for this shall not rest with Eco Mobility Aids, its owners, employees and affiliates.

8. Limitation of Liability

To the maximum extent permitted by law:

• We are not responsible for any indirect, incidental or consequential damages.

• Our total liability to you for any claim related to the Platform will not exceed the greater of (a) the amount you paid us in fees during the 3 months prior to the claim, or (b) £100.

9. Termination

We may suspend or terminate your account at any time if you violate these Terms or if we believe your actions may harm the Platform or other Users.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of England and Wales.
Any disputes will be subject to the exclusive jurisdiction of the courts in England and Wales.

11. Changes to Terms

We may update these Terms from time to time. Changes take effect upon posting to the Platform. Continued use of the Platform means you accept the updated Terms.
